These General Terms of Sale (hereinafter referred to as the
"GTS") govern all paid services offered by
SHABON within the Bulle application.
They supplement the
Terms and Conditions of Use, the
Privacy Policy and the
Code of Ethics, to which they expressly
refer.
By subscribing to any of the paid offers described below, you
acknowledge that you have read, understood and unreservedly accepted
these GTS in their entirety, as well as the Terms and Conditions of
Use, the Privacy Policy and the Code of Ethics.
1. Preamble and Definitions
1.1. Purpose
The purpose of these GTS is to define the conditions under which
Shabon provides Users of the Bulle Application with the following paid
services: the Premium Subscription, the Bulle Avenir Program and the
Ads Service.
1.2. Definitions
In addition to the definitions set forth in the
Terms and Conditions of Use, the following
terms shall have the meanings set out below:

"Premium Subscription": a monthly subscription
offering exclusive features and the removal of advertisements
-
"Bulle Avenir Program": a program granting access
to video content creation for semi-professional creators, subject to
approval and a one-time registration fee
-
"Ads Service": a service enabling any Certified
User to broadcast a promotional video subject to approval, based on
an impression credit system
-
"Credit": a distribution unit corresponding to one
(1) effective impression of an Ad delivered to a Standard, Verified
or Certified account
-
"Ad": a promotional video submitted by an
Advertiser through the Ads Service
-
"Advertiser": a User who has subscribed to the Ads
Service
-
"Client": any User subscribing to one of the paid
offers described in these GTS
-
"Editorial Committee": Shabon's internal body
responsible for evaluating applications to the Bulle Avenir Program
and validating Ads
1.3. Hierarchy of contractual documents
In the event of a conflict between these GTS and the Terms and
Conditions of Use, the GTS shall prevail with respect to all matters
concerning paid services. For all other matters, the Terms and
Conditions of Use, the Privacy Policy and the Code of Ethics shall
remain fully applicable.

3. Description of Offers
Shabon offers three categories of paid services within the Bulle
Application:
Summary of offers:

video publishing for approved semi-professional creators

a promotional video subject to approval
Each offer is subject to specific eligibility, approval and usage
conditions detailed in the following sections. All offers are governed
by these GTS, the
Terms and Conditions of Use and the
Code of Ethics.
4. Premium Subscription
4.1. Service description
The Premium Subscription offers the following benefits:

Complete removal of advertisements: no ads appear
in the video feed

Exclusive unicorn spirit animal badge: an exclusive
badge displayed on the subscriber's profile, symbolizing their
support for the development of Bulle
-
Unlimited Quiz usage: unlimited use of quizzes on
publications.

Support for the development of Bulle: Premium
Subscription revenue directly contributes to the funding and
improvement of the platform
4.2. Eligibility requirements
The Premium Subscription is available to any User with an active Bulle
account, regardless of their verification level (Standard, Verified,
Certified or Professional).
4.3. Duration and renewal

Duration: monthly subscription for an indefinite
period
-
Renewal: automatic on each anniversary date, unless
cancelled by the Client
-
Effective date: immediate upon payment confirmation
4.4. Cancellation of the Premium Subscription
-
The Client may cancel at any time from the Application settings or
via the relevant App Store / Google Play Store platform
-
Cancellation takes effect at the end of the current monthly period
-
The Client retains Premium benefits until the end of the paid period
-
No pro-rata refund shall be issued for the current period
5. Bulle Avenir Program (Semi-Professional Creator)
5.1. Program overview
The Bulle Avenir Program enables semi-professional creators to access
content publishing on Bulle, subject to meeting the eligibility
requirements and successfully completing the approval process by
Shabon's Editorial Committee.
Distinction between types of creators on Bulle:

Invited Creators and Media: professionals and
media outlets selected and invited directly by Shabon. They hold
Professional Creator status (Professional Level as defined in the
Terms and Conditions of Use) and may access remuneration subject to
certain conditions.
-
Bulle Avenir Creators: semi-professional creators
who have applied through the Bulle Avenir process, been approved by
the Editorial Committee, and having paid the one-time registration fee.
They do not have access to remuneration but may publish videos.
Progression to Professional status: a Bulle Avenir
Creator who has reached
10,000 Bulle subscribers including a minimum of 5,000 Certified subscribers
may apply for Professional Creator status, subject to a new approval
by the Editorial Committee.
5.2. Eligibility requirements
MANDATORY CUMULATIVE CONDITIONS:
To access the Bulle Avenir Program, the applicant must meet
all of the following conditions:

Minimum age: be at least
16 years of age (verified by identity document)

Certified Account: hold a Bulle account at the
Certified level (full identity verification)
-
Signing of the Code of Ethics: accept and sign
the Code of Ethics in its complete
version, including the obligations specific to creators
-
Approval by the Editorial Committee: submit an
application and be approved by Shabon's Editorial Committee, which
assesses the compatibility of the editorial project with the values
and editorial line of Bulle
-
Payment of the Bulle Avenir registration fee: pay the
one-time registration fee of €9.99 inclusive of all taxes
5.3. Application and approval process
-
Submission: the applicant completes the application
form available in the Application, describing their editorial
project, theme and motivations
-
Review: the Editorial Committee reviews the
application within an indicative period of 15 business days
-
Reasoned decision: in the event of rejection, the
Editorial Committee provides the applicant with a written
justification, in accordance with Bulle's principles of transparency
-
Appeal: the applicant may challenge the decision by
sending a reasoned appeal to
within 30 days
of notification of the rejection
5.4. Editorial Committee evaluation criteria
The Editorial Committee evaluates applications according to the
following criteria, without this list being exhaustive:
-
Editorial compatibility: alignment of the project
with the values and editorial line of Bulle (authenticity, quality,
responsibility)
-
Compliance with the Code of Ethics: absence of
divisive, controversial, proselytizing content, or content contrary
to the principles of the Code
-
Project quality: relevance, originality and
potential of the proposed content
-
Regulatory compliance: compliance with applicable
French and European legislation relating to the proposed theme
(particularly regarding advertising, health, regulated products)
GROUNDS FOR REJECTION: Without this list being
exhaustive, editorial projects concerning the following topics are
likely to result in rejection of the application:
- Political, activist or partisan content
-
Religious, sectarian, worship-related or proselytizing content
-
Unconventional medicine, scientifically unvalidated alternative
therapies, pseudo-sciences
-
Regulated products or substances (CBD, dietary supplements, etc.)
-
Controversial, divisive content or content likely to generate
toxic debates
-
Content likely to harm users' physical or mental health
- Any project incompatible with Bulle's editorial line
Note: Regarding sensitive topics (religion,
spirituality, alternative medicine, controversial societal issues),
Shabon is in the process of establishing an independent expert
committee tasked with defining clear guidelines. Pending the
establishment of this committee, Shabon cannot accept applications
relating to these topics.
5.5. Bulle Avenir Creator obligations
The Bulle Avenir Creator agrees to:

Comply with the Code of Ethics in its
entirety, including the obligations specific to creators
- Comply with these GTS and the Terms and Conditions of Use
-
Publish content consistent with the theme approved during their
application
-
Immediately report any change in their situation or editorial
project
-
Cooperate with the Editorial Committee and moderation teams
-
Not use the Bulle Avenir status for improper purposes (disguised
promotion, circumvention of advertising rules, etc.)
-
Maintain a level of quality and regularity of publication consistent
with the program's expectations
5.6. Remuneration and monetization
NO REMUNERATION: The Bulle Avenir Program does not
entitle the creator to
any remuneration from Shabon.
The Bulle Avenir Creator publishes at their own expense and receives no
revenue related to views, likes, shares or any other engagement metric.
Access to remuneration is reserved for Professional Creators (invited
by Shabon or who have progressed from the Bulle Avenir program after
reaching 10,000 subscribers including 5,000 Certified subscribers and
being approved by the Editorial Committee).
5.7. Duration and cancellation

Duration: the Bulle Avenir registration grants
access for an indefinite period, taking effect after approval of
the application and confirmation of the one-time payment.
-
No renewal required: the one-time registration fee
grants permanent access to the Bulle Avenir Program as long as the
creator complies with the applicable terms.
-
Voluntary withdrawal by the Client: the Client may
request to leave the Bulle Avenir Program at any time by contacting
. Published
videos remain online unless explicit deletion is requested. The
registration fee is non-refundable.
-
Cancellation by Shabon: Shabon reserves the right
to revoke the Bulle Avenir registration at any time, without notice
and without compensation, in the event of a breach of the Terms and
Conditions of Use, GTS, Code of Ethics, or if the published content
no longer meets the initial approval criteria.
5.8. Revocation of Bulle Avenir status
The Editorial Committee reserves the right to revoke Bulle Avenir
status at any time if:
- The creator violates the Code of Ethics or the Terms and Conditions of Use
- The published content deviates from the approved theme
- The content no longer meets Bulle's quality standards

The creator engages in behavior incompatible with the platform's
values
-
The creator does not publish any content for 3 consecutive months
without justification
Revocation of the status results in the loss of the ability to publish
videos. The registration fee is non-refundable.
6. Ads Service
6.1. Service description
The Ads Service enables any User with a Certified account (minimum age
of 18, verified) to broadcast a promotional video to Bulle Users,
based on an impression credit system.
6.2. Eligibility requirements

Hold a Bulle account at the
Certified level (full identity verification)
- Be a legal adult (minimum age of 18, verified)
-
Have accepted these GTS, the Terms and Conditions of Use and the Code of Ethics
6.3. Credit system operation
Credit system:
- 1 purchase = €9.99 incl. taxes = 1,000 credits
-
1 credit = 1 effective impression delivered to a
Verified or Certified account
-
The Ad is broadcast until
all purchased credits are exhausted
-
Unused credits expire 12 months after the date of
purchase
-
Credits are
non-transferable, non-assignable and non-refundable
6.4. Targeting options
The Advertiser may configure the following distribution criteria:
-
Age group: targeting by User age group (e.g.,
18-25, 25-35, etc.)
-
Approximate location: targeting by geographic area
the size of a major city (approximately 20 km radius). The exact
location of Users is never disclosed to the Advertiser.
-
Certification level: targeting by User account
level (Standard, Verified, Certified)
-
Declared interests: targeting by interest
categories selected by Users in their settings
DATA PROTECTION:
-
Ad filtering is performed
entirely internally by Shabon's servers
-
No personal data of Users is communicated,
transmitted, sold or rented to the Advertiser
-
The Advertiser only receives
aggregated and anonymized statistics (number of
impressions consumed, distribution by age group and geographic
area, without individual identification)
-
Filtering is performed
directly on the User's profile based on the
configured criteria, without any data transmission
-
No cookies, trackers or third-party identifiers are used in
connection with the Ads Service
6.5. Submission and approval process
-
Application form: an initial review of the
Advertiser's motivations by the Editorial Committee is required to
ensure compliance with Shabon's rules and Code of Ethics.
-
Payment: the payment of €9.99 is made before
identity verification and submission. Credits are added to the
Advertiser's account but are only activated after approval.
-
Submission: the Advertiser submits their video via
the dedicated form in the Application, along with a description and
the desired targeting criteria
-
Approval: the Editorial Committee reviews the Ad
within an indicative period of 5 business days. The Committee
verifies compliance with these GTS, the Terms and Conditions of Use,
the Code of Ethics and applicable regulations.
-
Broadcast: upon approval, the Ad is broadcast to
Users matching the targeting criteria, until credits are exhausted or
expire.
-
Rejection: in the event of rejection, the Editorial
Committee notifies the Advertiser with a written justification.
No refund is issued (see Section 9). The Advertiser
may submit a modified version of the Ad within 30 days.
6.6. Advertiser obligations
The Advertiser agrees to:

Submit Ads that
comply with applicable French and European legislation,
including Regulation (EU) 2022/2065 (Digital Services Act),
Regulation (EU) 2019/1150, Directive 2005/29/EC on unfair commercial
practices and the French Code de la consommation (Consumer Code)
-
Comply with the
prohibited content and activities
defined in Section 10
-
Warrant that they hold all necessary rights to the submitted content
(copyright, image rights, trademarks, etc.)
-
Warrant the truthfulness and fairness of the information contained
in the Ad
-
Not mislead Users regarding the nature, characteristics, price or
availability of the products or services promoted
-
Clearly state any applicable legal obligation (mandatory
disclosures, terms of sale, etc.)
-
Assume full responsibility for the content of their Ad and the
products or services promoted
6.7. Right of removal
Shabon reserves the right to remove any Ad at any time, even after
approval and broadcast, if it considers that the Ad violates these
GTS, the Terms and Conditions of Use, the Code of Ethics, applicable
regulations, or damages the image, reputation or interests of Bulle or
its Users. The removal of an Ad does not entitle the Advertiser to any
refund or compensation.
7. Pricing and Payment Terms

Prices are stated in euros, inclusive of all taxes (TTC), including
applicable French VAT.
7.2. Payment methods

Payments for the Premium Subscription and the Bulle Avenir
registration fee are processed through the integrated payment
systems of the distribution platforms (Apple App Store, Google Play
Store) in accordance with their respective terms and conditions
-
Payments for the Ads Service are processed through the payment
systems integrated in the Application
-
Shabon accepts the payment methods offered by the distribution
platforms (credit card, etc.)
7.3. Price changes
Shabon reserves the right to change prices at any time. Any price
change shall be notified to the Client at least
30 days before it takes effect. The Client who does
not wish to accept the new price may cancel their subscription before
the effective date of the change.
7.4. Invoicing
Invoices are issued by the relevant distribution platform (Apple,
Google) for the Premium Subscription and Bulle Avenir registration
fee, and by Shabon for the Ads Service. Invoices
are available in the Application settings and/or through the
distribution platforms.
8. Right of Withdrawal
8.1. Principle
In accordance with Articles L. 221-18 et seq. of the Code de la
consommation (Consumer Code), the consumer Client has a right of
withdrawal of 14 days from the date of subscription,
without reason and without penalty.
8.2. Waiver of the right of withdrawal
EXPRESS WAIVER:
In accordance with Article L. 221-28 of the Code de la consommation
(Consumer Code), the Client acknowledges and expressly agrees that:
-
For the Premium Subscription: the
performance of the service begins immediately upon subscription,
at the express request of the Client. The Client therefore
expressly waives their right of withdrawal from the moment the
service begins.
-
For the Bulle Avenir Program: as access is
granted immediately upon payment of the one-time registration
fee, the Client expressly waives their right of withdrawal from
the moment access is provided.
-
For the Ads Service: as credits are digital
content provided immediately, the Client expressly waives their
right of withdrawal upon confirmation of the purchase and the
provision of the credits.
8.3. Exercise of the right of withdrawal
If the right of withdrawal is applicable (service not yet commenced),
the Client may exercise it by sending a clear request to
within the
14-day period. The refund shall be made within 14 days of receipt of
the request, using the same payment method.
9. Refund Policy
STRICT NO-REFUND POLICY:
Except where mandatory legal provisions require otherwise and
subject to the right of withdrawal provided for in Section 8,
no refund shall be issued in the following cases:

Premium Subscription: cancellation during the
current period, dissatisfaction, change of mind
-
Bulle Avenir Program: voluntary withdrawal,
revocation of status for breach of rules, non-publication of
content (the one-time registration fee is non-refundable)
-
Ads Service, Rejection of approval: if the Ad is
rejected by the Editorial Committee, credits remain available for
30 days for the submission of a modified version. After this
period, credits are forfeited without refund.
-
Ads Service, Removal of an Ad: if an Ad is
removed after approval for violation of the rules, consumed credits
are not restored and remaining credits are cancelled without
refund.
-
Ads Service, Expiration of credits: credits not
used within the 12-month period expire without refund.
-
Account suspension or ban: in the event of
suspension or ban for violation of the Terms and Conditions of Use,
GTS or Code of Ethics, no refund is due; all credits, current
subscriptions and Bulle Avenir access are cancelled.
9.1. Exceptions
Shabon shall only issue refunds in the following cases:
-
Proven technical error by Shabon resulting in a
duplicate charge or erroneous charge
-
Valid exercise of the right of withdrawal under the
conditions of Section 8
-
Mandatory legal obligation requiring a refund
9.2. Complaint procedure
Any refund request must be sent by email to
within
30 days of the triggering event, accompanied by the
necessary supporting documents. Shabon undertakes to respond within 15
business days.
10. Prohibited Content and Activities in Ads
ABSOLUTE PROHIBITIONS:
In addition to the prohibitions set forth in the
Terms and Conditions of Use and the
Code of Ethics, it is
strictly prohibited to broadcast through the Ads
Service any content or promotion relating to:
10.1. Political content
In accordance with Regulation (EU) 2024/900 on transparency and
targeting of political advertising:
- Political, electoral or referendum advertising
-
Promotion of political parties, candidates or political movements
- Activist, partisan or ideological content
- Political propaganda of any kind
- Disguised lobbying or promotion of political positions
10.2. Regulated or prohibited products and services
-
Tobacco and related products: cigarettes, cigars,
heated tobacco products, electronic cigarettes, vaping liquids
(Directive 2014/40/EU)
-
Alcohol: alcoholic beverages except under the
strict conditions of the loi Evin (Code de la santé publique
(Public Health Code), Articles L. 3323-2 et seq.)
-
Narcotics and psychoactive substances: drugs,
cannabis derivatives (unless in full and proven compliance with
applicable regulations), hallucinogenic mushrooms, poppers
-
Medicines and medical devices: unless in strict
compliance with the Code de la santé publique (Public Health Code)
and authorized by the ANSM
-
Dietary supplements: with health claims not
authorized under Regulation (EC) 1924/2006
-
Weapons and ammunition: firearms, bladed weapons,
explosives, armament accessories
-
Gambling and betting: except for operators licensed
by the ANJ (Autorité nationale des jeux), with mandatory disclosures
-
High-risk financial products: crypto-assets (unless
in compliance with the MiCA Regulation), forex, binary options, CFDs
aimed at retail investors
-
Counterfeit or fraudulent products: counterfeits,
copies, stolen goods
10.3. Misleading or dangerous content
-
False or misleading advertising within the meaning of Directive
2005/29/EC
-
Scientifically unproven health, therapeutic or medical claims
-
Unconventional medicine, unvalidated alternative therapies,
pseudo-sciences
-
Unrealistic promises of results (income, weight loss, cure, etc.)
- Pyramid schemes, misleading multi-level marketing (MLM)
- Scams, fraud of any kind
-
Content likely to harm Users' physical or mental health
10.4. Content contrary to Bulle's values
-
Religious, sectarian, worship-related or proselytizing content
- Violent, pornographic, sexually explicit content
-
Discriminatory, hateful, racist, sexist, homophobic, transphobic
content
- Harassment, intimidation or threatening content
- Disinformation, fake news, manipulation content
-
Content specifically targeting minors in an inappropriate manner
-
Content inciting dangerous, self-destructive or illegal behavior
10.5. Prohibited targeting
-
Targeting minors under 18 years of age for
regulated products or services (alcohol, gambling, etc.)
-
Targeting based on sensitive data (ethnic origin,
political opinions, religious beliefs, health, sexual orientation)
-
Targeting using
psychological manipulation techniques (dark
patterns, exploitation of vulnerabilities)
SANCTIONS: Any violation of the above prohibitions
shall result in the immediate removal of the Ad, cancellation of
remaining credits without refund, and may lead to the suspension or
permanent ban of the account, as well as a report to the competent
authorities. Shabon reserves the right to pursue legal action.
11. Limitation of Liability
11.1. Ads Service
Shabon disclaims all liability with respect to:

The commercial performance of Ads (number of
clicks, conversions, sales, return on investment)
-
The suitability of the Ad for the Advertiser's
commercial objectives
-
The expected results of the Advertiser in terms of
visibility, brand awareness or revenue
-
The products or services promoted by the
Advertiser, for which the Advertiser assumes full responsibility
-
Disputes between the Advertiser and Users resulting
from an Ad
-
Any
interruption, malfunction or unavailability of the
Ads Service
-
The loss of credits resulting from a technical
malfunction, account suspension or any other cause
11.2. Bulle Avenir Program
Shabon disclaims all liability with respect to:
-
The visibility or reach of content
published by Bulle Avenir Creators
-
The
number of subscribers, views or interactions
obtained
-
The content published by Bulle Avenir Creators, for
which they assume full responsibility
-
The decisions of the Editorial Committee, made in
good faith
-
The
professional or personal consequences related to
the rejection, revocation of status or termination of access to the
program
11.3. Premium Subscription
Shabon disclaims all liability with respect to:
-
Any temporary interruption of the ad-free
experience resulting from a technical malfunction
-
The permanent availability of all Premium features
11.4. Overall limitation
IN NO EVENT SHALL SHABON'S TOTAL LIABILITY UNDER THESE GTS
EXCEED THE TOTAL AMOUNT PAID BY THE CLIENT DURING THE 12 MONTHS
PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
This limitation applies even if Shabon has been informed of the
possibility of such damages and regardless of the nature of the
liability.
11.5. Indemnification
The Client agrees to defend, indemnify and hold harmless Shabon
against any claim, loss, cost or damage arising from or related to
their use of the paid services, the content of their Ads, their
publications as a Bulle Avenir Creator, or any breach of these GTS.
This obligation survives termination.
12. Termination and Suspension
12.1. Termination by the Client
The Client may terminate their Premium subscription at any time via the
Application settings or via the relevant distribution platform.
Termination takes effect at the end of the current monthly period. No
pro-rata refund is issued. For the Bulle Avenir Program, the Client
may request to leave at any time; the one-time registration fee is
non-refundable.
12.2. Termination by Shabon
Shabon reserves the right to terminate or suspend any subscription or
service, without notice and without compensation, in the event of:
- Breach of the Terms and Conditions of Use, GTS or Code of Ethics
- Fraudulent, deceptive or illegal activity
- Non-payment
-
Behavior damaging to the image or interests of Bulle
- Decision of the Editorial Committee (for Bulle Avenir)
- Discontinuation of the relevant service (with 30 days' notice)
12.3. Consequences of termination
-
Immediate loss of benefits associated with the subscription or
service
- Cancellation of all remaining credits (Ads Service)
- No refund
-
The limitation of liability and indemnification clauses survive
termination
13. Intellectual Property
The intellectual property provisions set forth in the
Terms and Conditions of Use (Section 8)
apply in full to the services governed by these GTS.
By submitting an Ad, the Advertiser warrants that they hold all
necessary intellectual property rights to the submitted content and
grants Shabon a license on the same terms as those provided in the
Terms and Conditions of Use for user content.
14. Personal Data Protection
The processing of personal data in the context of paid services is
governed by the Privacy Policy of Bulle.
In particular, for the Ads Service, Shabon reiterates that
no personal data of Users is communicated to
Advertisers. Filtering is performed entirely internally and
Advertisers only receive aggregated and anonymized statistics.
15. General Provisions
15.1. Entirety
These GTS, together with the Terms and Conditions of Use, the Privacy
Policy and the Code of Ethics, constitute the entire agreement between
the Client and Shabon regarding the paid services.
15.2. Severability
If any provision of these GTS is declared invalid by a court of
competent jurisdiction, the remaining provisions shall remain in full
force and effect.
15.3. Non-waiver
Shabon's failure to exercise a right provided for in these GTS shall
not constitute a waiver of that right.
15.4. Amendments
Shabon reserves the right to amend these GTS at any time. In the event
of a material amendment, the Client shall be notified by notification
in the Application or by email at least
30 days before it takes effect. Continued use of the
paid services after that date constitutes acceptance.
16. Governing Law and Jurisdiction
16.1. Governing law
These GTS are governed by
French law and
European Union law.
16.2. Mandatory prior mediation
AMICABLE DISPUTE RESOLUTION:
In accordance with Articles L. 612-1 et seq. of the Code de la
consommation (Consumer Code), before any legal action, the parties

16.3. Competent jurisdiction
In the absence of an amicable resolution, any dispute shall be subject
to the exclusive jurisdiction of the courts of Paris,
without prejudice to mandatory jurisdiction rules applicable to
consumers.
